GENERAL

Website Pipeline, Inc. d/b/a websitepipeline™ and CIMcloud respects the privacy of every individual who visits our websites, responds to any of our mailings, or sends us e-mail. This Privacy Policy outlines the information websitepipeline™ will collect and how we will use that information. This Privacy Policy will also instruct you on what to do if you do not want your Personal Data collected or shared when you visit our websites, respond to our web-based mailings or send us email.

If you reside in the European Economic Area ("EEA"), you may have additional rights with respect to your Personal Data, as further outlined below. These rights may include rights under the EU's General Data Protection Regulation ("GDPR"), if you are a resident of the EEA.

Websitepipeline™ will be the controller of your Personal Data (defined below) that is provided, collected and/or processed pursuant to this Privacy Policy, except where otherwise expressly stated below when we act as a processor (See Residents of the European Economic Area ("EEA") below) . If you have any questions about whether any of foregoing applies to you, please contact us using the information set forth in the "Contact Us" section below.

This Privacy Policy may be updated from time to time for reasons such as operational practices or regulatory changes, so we recommend that you review our Privacy Policy when returning to our website.

PERSONAL DATA

Websitepipeline™ will not collect any Personal Data about you (that is, your name, address, telephone number, email address, credit card billing information, etc.) unless you provide it to us voluntarily.

The following are some examples of when websitepipeline™ may require that you provide Personal Data:

  • To complete an online order for a product or service
  • To register as an eSeller, Freelancer, or customer
  • To request more information about new or current websitepipeline™ products or services
  • Contact us for customer support, technical support, or general inquiry

CHOICE

You can choose whether to provide Personal Data to Websitepipeline™, but note that you may be unable to access certain options, offers, and services if they require Personal Data that you have not provided. You can sign-up, and therefore consent, to receive email or newsletter communications from us. If you would like to discontinue receiving these communications, you can update your preferences by using the "Unsubscribe" link found in such emails or by contacting us using the information in the "Contact Us" section of this policy.

If you do not want your Personal Data collected, please do not submit it to us. If you have already submitted this information and would like for us to remove it from our records, please contact us at the address listed at the bottom of this Statement. We will use reasonable efforts to delete your information from our existing files.

PROCESSING AND USE OF YOUR PERSONAL DATA

We will process and use your Personal Data only in accordance with our Privacy Statement. If you do not wish us to continue using your Personal Data in this manner, you can request that your account be deactivated by contacting us as specified in the "Contact Us" section.

We will only process and use your Personal Data if we have a lawful basis for doing so. Lawful bases for processing include consent, contractual necessity (i.e. processing that is necessary for the performance of a contract with you, such as your user agreement with us that allows us to provide you with our services ) and our "legitimate interests" or the legitimate interest of others (e.g. our users).

DATA RETENTION

How long we retain your Personal Data depends on the type of data and the purpose for which we process the data. We will not retain your Personal Data for longer than required. This means that we will keep your Personal Data for any or a combination of time periods described as follows: (i) for as long as required by law, (ii) until we no longer have a valid reason for keeping it, or (iii) until you request us to stop using it . When we delete information, our back-up system retains a copy until it cycles out in the normal course.

SHARING YOUR PERSONAL DATA

We do not sell or rent your Personal Data to third parties for marketing purposes unless you have granted us permission to do so.

We share Personal Data within Websitepipeline™ and its affiliated companies, and with third- party service providers for purposes of data processing or storage.

We also share Personal Data with business partners, service vendors and/or authorized third-party agents or contractors in order to provide requested services or transactions, including processing orders, processing credit card transactions, hosting websites, hosting event and seminar registration and providing customer support. We provide these third parties with Personal Data to complete/utilize the requested Product or transaction.

In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third-party. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your Personal Data as set forth in this policy. As required by law, we may respond to subpoenas, court orders, or similar legal process by disclosing your Personal Data and other related information, if necessary. We also may use Personal Data and other related information to establish or exercise our legal rights or defend against legal claims.

We collect and possibly share Personal Data and any other additional information available to us in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Websitepipeline™'s terms of service, or as otherwise required by law.

While navigating Websitepipeline™'s website or services, you may be directed to content or functionality that is hosted by a third-party. When information is collected on behalf of Websitepipeline™ exclusively, Websitepipeline™'s Privacy Policy will be referenced and will govern how your information is used. For other, non-Websitepipeline™ sites or services, the site/service owner's privacy policy will be referenced. You should review such third-party's privacy and security policies prior to use.

TRANSFER AND STORAGE OF PERSONAL DATA

If you are from outside the U.S., understand that you are sending Personal Data and Usage Data to the United States where our servers are located. That information may be then transferred within the U.S. or back out of the U.S. to other countries outside of your country of residence. Except for the U.S. and our certification for the Privacy Shield, these countries many not necessarily have data protection laws as comprehensive or protective as those in your country of residence; however, our collection, storage, and use of your Personal Data and Usage Data will at all times be governed by this Privacy Policy.

By providing any Personal Data for any of the purposes stated in this Privacy Policy, you consent to the transfer and storage of your Personal Data, whether provided by you or obtained through a third-party, to the U.S. as set forth herein, including the hosting of such Personal Data on U.S.-based servers.

SECURITY OF YOUR PERSONAL DATA

We are committed to protecting the security of your Personal Data. We use a variety of security technologies, procedures, and organizational measures to help protect your Personal Data from unauthorized access, use, or disclosure. For example, we store the Personal Data you provide on computer systems with limited access that are in controlled facilities. When we transmit highly confidential information (such as a credit card number) over the Internet, we protect it using encryption, such as the Secure Socket Layer (SSL) protocol.

NON-PERSONAL INFORMATION

In some cases, we may collect information about you that is not personally-identifiable under applicable law at the time it is collected, and we do not attempt to convert this data to identifiable Personal Data. Examples of this type of information include the type of Internet Browser you are using, the type of computer operating system you are using, and the domain name of the web site and/or Internet Service Provider from which you linked to our site or advertisement. We may use Non-Personal for any lawful purpose.

RESIDENTS OF THE EUROPEAN ECONOMIC AREA ("EEA")

If you are located in the EEA, you have certain rights under European law with respect to your Personal Data described below.

  • Access: You can request more information about the Personal Data we hold about you. You can also request a copy of the Personal Data.
  • Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data. You can also correct some of this information directly by logging into your service account. Please contact us as soon as possible upon noticing any such inaccuracy or incompleteness.
  • Objection: You can contact us to let us know that you object to the collection or use of your Personal Data for certain purposes.
  • Erasure: You can request that we erase some or all of your Personal Data from our systems.
  • Restriction of Processing: You can ask us to restrict further processing of your Personal Data.
  • Portability: You have the right to ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another entity where technically feasible.
  • Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our services.
  • Right to File Complaint: You have the right to lodge a complaint about Websitepipeline™'s practices with respect to your Personal Data with the supervisory authority of your country or EU Member State.

If you are a merchant, a partner, a visitor to CIMcloud's websites, or a user of CIMcloud's support services and wish to exercise any of the foregoing rights, please contact us using the Contact Us section below.

If you are a customer of a merchant who uses CIMcloud's platform and wish to exercise these rights, please contact the merchants you interacted with directly. We serve as a processor on their behalf and can only forward your request to them to allow them to respond.

Additionally, if you are located in the EEA, we note that we are generally processing your information in order to fulfill contracts we might have with you or otherwise to pursue our legitimate business interests, unless we are required by law to obtain your consent for a particular processing operation. In particular we process your Personal Data to pursue the following legitimate interests, either for ourselves, our merchants, our partners, or other third parties (including our merchants' customers):

  • To provide merchants and others with our services and applications;
  • To prevent risk and fraud on our platform;
  • To provide communications, marketing, and advertising;
  • To provide reporting and analytics;
  • To help merchants find and integrate with apps through our app store;
  • To provide troubleshooting, support services, or to answer questions;
  • To test out features or additional services; and
  • To improve our services, applications, and websites.

When we process Personal Data to pursue these legitimate interests, we do so where we believe the nature of the processing, the information being processed, and the technical and organizational measures employed to protect that information can help mitigate the risks to the data subject.

CHILDREN

websitepipeline™ has no intention of collecting any Personal Data (that is, name, address, telephone number, or email address) from individuals under 18 years of age. Where appropriate, websitepipeline™ will specifically instruct children not to submit such information on our web sites or advertisements without consent of a parent or guardian. If a child has provided us with Personal Data without the consent of a parent or guardian, a parent or guardian of that child should contact us at the email address listed at the bottom of this Statement if they would like this information deleted from our records. We will use reasonable efforts to delete the child's information from our existing files.

COOKIES

When you view one of our websites we may store some information on your computer. This information will be in the form of a "cookie" or similar file and will be used to determine ways to improve our web sites, advertisements, products or services. For example, cookies allow us to tailor a web site to better match your interests and preferences. With most Internet Browsers, you can erase cookies from your computer hard drive, block all cookies, or receive a warning before a cookie is stored. Please refer to your Browser instructions or help screen to learn more about these functions.

If you would prefer not to accept cookies or otherwise wish to disable our use of cookies refer to your browser settings for how to do so. Please note that doing so may negatively impact your experience using our services, as some features may not work properly.

WEB BEACONS

websitepipeline™ web pages may contain electronic images known as web beacons - sometimes called single-pixel gifs - that allow us to count users who have visited those pages and to deliver co-branded services. We may include web beacons in promotional e-mail messages or newsletters to count how many messages have been opened and acted upon. Web beacons are not used to access your Personal Data; they are a technique we use to compile aggregated statistics about web site usage. Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the web beacon resides.

DO-NOT-TRACK SIGNALS

Some Web browsers incorporate a "Do Not Track" feature that signals to websites that you visit that you do not want to have your online activity tracked. Each browser communicates "Do Not Track" signals to websites differently, making it unworkable to honor each and every request correctly. In order to alleviate any communication error between browsers and website, we do not respond to "Do Not Track" signals at this time. As the technology and communication between browser and website improves, we will reevaluate the ability to honor "Do Not Track" signals and may make changes to our policy.

CHANGES TO THIS PRIVACY POLICY

websitepipeline™ will occasionally modify this Privacy Privacy. When we post modifications to this Privacy Policy, we will include the date at the top of this Privacy Policy. websitepipeline™ encourages you to periodically review this Privacy Policy to be informed of how we are protecting your information.

CHANGES TO THIS PRIVACY POLICY

Regarding Personal Data, if any modifications are materially less restrictive on our use or disclosure of the Personal Data previously disclosed by you, we will notify you by email and/or by posting a pop-up notice on this website.

LOCATION INFORMATION

In some cases, we may collect limited location information. For example, we may use Google Analytics to convert your IP address into a rough geolocation to understand in what areas our users are located and to improve and personalize CIMcloud (for example, to display time data in the correct local time).
